Insurance Requirements

Certificates of Insurance must list the following as the Certificate Holder:

The Contractor must be insured by a responsible insurance company for:

  1. Workers' compensation insurance, as required by law.
  2. Public liability insurance in at least the policy limits as specified in Chapter 61G4 and Chapter 61G6, Florida Administrative Code .
  3. Property damage insurance in the amount specified in Chapter 61G4 and Chapter 61G6, Florida Administrative Code .

Workers Compensation Insurance Requirements

Construction Industry Requirements:

  • Employers with one or more employees, including the owner of the business who are corporate officers or Limited Liability Company (LLC) members, must have workers' compensation coverage. For a list of the trades considered to be in the construction industry see 69L-6.021 Florida Administrative Code 
  • Out of State employers are required to obtain a workers’ compensation insurance policy with "Florida" specifically listed in Section 3A of the policy on the information declaration page.

Workers Compensation Insurance Exemption

Corporation:

  • The corporation must be registered and listed as active with the Florida Department of State, Division of Corporations.
  • The applicant must be listed as an officer of the corporation in the records of the Florida Department of State.
  • The applicant must attest to a minimum 10 percent ownership of the corporation.
  • No more than three officers of a corporation or of any group of affiliated corporations (including LLCs) may elect to be exempt.

Limited Liability Company:

  • The Limited Liability Company (LLC) must be registered and listed as active with the Florida Department of State, Division of Corporations.
  • The applicant must attest to a minimum 10 percent ownership of the LLC.
  • No more than three officers of an LLC or of any group of affiliated LLCs (including corporations) may elect to be exempt.

Marine Contractor Requirements

  • Marine Contractors are required to maintain Workers Compensation Insurance with United States Longshore & Harbor Workers (USL&H). This includes all Residential, Building, and General Contractors performing marine work.
  • For any marine project over water, the workers compensation insurance policy must reflect proper USL&H coverage or have the appropriate rider.
